Terms and Conditions
1) Scope / General
The following rules will apply to all transactions, even if not in later transactions referred to again. The customer declares his order that he Kaufmann iS the Commercial Code, legal entity under public law or public law special fund. Upon receipt of the order confirmation or invoice or receipt of our delivery, the purchaser of the following conditions, without requiring an express written or verbal acceptance.
2) Pricing
All our offers are subject to change. The prices are net prices are ex VAT plus freight and Germany, we sell exclusively to resellers, manufacturers and wholesalers. At initial registration, the customer agrees to voluntarily its certificate of registration (business license) to send.
The minimum order is 150, - € netto.
3) Payment and invoicing
Unless otherwise agreed delivery shall be made against advance payment by parcel post at our discretion.
By placing an order the buyer confirms that he is creditworthy. If after placing the creditworthiness of the customers seem doubtful, so this is the information provided by a bank or credit agency to prove. Auftragsannulierungen are valid only with our consent. In this case we are for the loss of earnings as compensation to 20% of the agreed net purchase price amount. For payment we are authorized without any prior notice, to charge default interest at a rate of 9% over base rate of the Federal Bank from the due date.
4) Retention of title
The delivered goods until full payment of the purchase price as well as to the final settlement of all within the business relationship, and still developing our property liabilities.
5) Delivery
All deliveries, including any returns made on the account and risk of the buyer. Deliveries / collections in EC and non-EC countries are made exclusively to the invoice recipient. Delivery dates are given in good faith. Unforeseen obstacles delivery, such as cases of force majeure, strikes, breakdowns in their own company or in that of pre-or sub-contractors shall entitle us to postpone delivery or cancel the contract in whole or in part. Damage claims by the buyer for late delivery or non-delivery are excluded in any case.
6) Complaints
Complaints (eg, production errors, shortages, damage, wrong delivery) should be reported in writing within 7 working days of receiving the goods, in each case before resale, disposal or destruction. In case of justified complaints, at our discretion, replacement, repair or payment of the invoice for the goods under complaint. Here, the buyer bears up to a total value of the return of € 50, - € net any shipping costs.
7) Return of goods:
7.1 Goods only when we take back our prior written consent. A commitment to return of goods on our part not accepted by us without defects.
8) Withdrawal
The right of revocation according to § 355 BGB applies only to consumers and individuals and is therefore ineffective in distance contracts trader.
9) Copyright:
Be 9.1 Our designs, images, patterns, models, and the like are regarded as our intellectual property and may by the buyer (without our written consent), even if there do not have specific rights, neither imitated nor otherwise used for simulation.
Any violation of the power purchaser for damages.

10) Performance and Jurisdiction

11) Final provision
The ineffectiveness of the above provisions shall not affect the validity of the other.
